EFFECTIVE DATE: 28.05.2026

1. Nature of Digital Products

All products sold by GroomKit Pro via groomkit.pro are digital content („Products”) — intangible goods delivered exclusively in electronic form. No physical items are manufactured, packaged, or dispatched. Digital delivery occurs immediately upon confirmation of successful payment.

Because of the inherently immediate and irreversible nature of digital content delivery, the statutory rules governing the right of withdrawal applicable to physical goods do not apply in the same way to our Products.

2. Waiver of Right of Withdrawal — Legal Basis

2.1. Applicable Law

Under EU Directive 2011/83/EU on Consumer Rights, Article 16(m), the 14-day right of withdrawal does not apply to the supply of digital content which is not supplied on a tangible medium if performance began with the consumer’s prior express consent and acknowledgement that the right of withdrawal would thereby be lost.

GroomKit Pro relies on this exemption. Accordingly, by completing a purchase, you expressly consent to immediate delivery of the digital content and acknowledge that, upon commencement of delivery (which occurs immediately upon payment confirmation), your statutory 14-day right of withdrawal is extinguished.

2.2. Mandatory Checkout Checkbox — Required Text

The following checkbox must be presented at the checkout step, must be un-ticked by default, and must be ticked by the customer before payment can be completed. This checkbox constitutes the express consent required by Art. 16(m) of Directive 2011/83/EU.

2.3. Confirmation of Mandatory Implementation

The above checkbox: (a) must be presented as un-ticked (pre-ticked boxes are unlawful under GDPR and EU Consumer Rights law); (b) must be a separate, standalone checkbox — it must not be bundled with acceptance of Terms of Service or any other consent; (c) must be mandatory — the checkout process must not permit progression to payment if the box is unticked; and (d) the customer’s consent, together with a timestamp and session identifier, must be recorded and stored by GroomKit Pro for a minimum of 5 years as proof of waiver.

3. All Sales Are Final — Scope

Subject to Section 4 (defective products only), no refunds, exchanges, or credits will be issued under any circumstances, including but not limited to:

  • Change of mind or buyer’s remorse after purchase.
  • Accidental purchase: it is the customer’s sole responsibility to review the product description, preview (where available), and compatibility information before completing a purchase.
  • Software incompatibility: compatibility requirements are stated in each product description as at the date of publication. GroomKit Pro does not guarantee compatibility with software versions released after the product’s publication date.
  • Partial use: no partial refund is available in respect of courses, knowledge systems, or any other Products where only part of the content has been accessed or used.
  • Failure to download within the specified period (30 days from purchase).
  • Dissatisfaction with the design, aesthetics, style, or approach of a Product.
  • Failure of the Product to produce specific business results, financial outcomes, or other expected results.
  • Purchase made by an ineligible user (e.g., a minor without parental consent, or a person purchasing on behalf of a third party without written authorisation).

4. Sole Exception — Technically Defective Product

Pursuant to EU Directive 2019/770/EU on the supply of digital content and digital services (Articles 14 and 16), where a Product is objectively defective — meaning the digital file is corrupted, inaccessible, or fundamentally non-conforming with the description provided at the time of purchase, and which defect is attributable to GroomKit Pro — the following remedy process applies:

Step 1 — Report: The customer must report the defect by email to support@groomkit.pro within 14 calendar days of the date of purchase. The report must include: (a) the order number; (b) a clear description of the defect; (c) screenshots or error messages where applicable; and (d) the steps taken to access or use the Product.

Step 2 — Repair or Replacement: GroomKit Pro will acknowledge the report within 3 business days and will endeavour to repair or replace the defective Product within 7 business days of acknowledgement. GroomKit Pro reserves the right to request further information from the customer where necessary.

Step 3 — Refund as Last Resort: If GroomKit Pro is unable to repair or replace the defective Product within 14 calendar days of the original defect report, a full refund of the purchase price shall be issued as the sole and final remedy.

The following do NOT constitute technical defects for the purposes of this Section:

  • The customer dislikes the design, layout, colour scheme, style, or overall approach of the Product.
  • The Product does not meet the customer’s subjective expectations of quality or suitability.
  • The Product fails to produce the specific business, financial, or personal results anticipated by the customer.
  • The Product is incompatible with software versions not listed in the compatibility information at the time of purchase.

5. Fraudulent Chargebacks

Initiating a payment reversal or chargeback with your bank, card issuer, or payment processor in respect of a successfully delivered and functional Product — without first following the defect reporting procedure in Section 4 — constitutes a material breach of these Terms of Service and this Policy.

In the event of a fraudulent or unjustified chargeback, GroomKit Pro reserves the right to:

  • Revoke access to the Product and any associated download links.
  • Permanently blacklist the email address, IP address, and payment method associated with the transaction.
  • Dispute the chargeback with the relevant payment processor, providing evidence of delivery and the customer’s prior consent to the no-refund policy.
  • Seek recovery of chargeback processing fees and associated administrative costs.

GroomKit Pro maintains records of delivery, consent timestamps, and Product access logs for the purpose of defending against fraudulent chargebacks.

6. How to Report a Defective Product

Please include in your email: your full name, the email address used at checkout, your order number, a detailed description of the issue, and any supporting screenshots or error messages. Reports submitted without an order number or adequate description may be subject to delay.

7. Governing Law

This Policy is governed by the laws of the Republic of Poland. Nothing in this Policy affects your statutory rights under EU consumer protection law, including EU Directive 2019/770/EU, which cannot be excluded or waived by agreement.
